The holiday pay headache
The Holidays Act (2003) is the central piece of legislation that outlines leave entitlements to employees in New Zealand. Included in the Act is the approach to calculate and pay employees for annual leave, domestic violence leave, sick leave, bereavement leave, alternate day leave, public holiday entitlements or any other leave taken.
Whilst these calculations are not necessarily complicated, they can be complex. Errors often occur by using payroll systems that are not fit for purpose or that are incorrectly configured to meet the Holidays Act's requirements.
Issues are most prevalent for employees who have irregular working patterns; work overtime; and/or receive commissions, bonuses or other allowances.
The implications from incorrectly calculating holiday pay can be significant. Not only might an employee have been paid too much or too little; there are also flow on effects to PAYE, KiwiSaver, Working for Families and Student Loans, along with breaches to individual and collective employment agreements.
Employers have a legal responsibility to fix these issues and comply with the Act. This process includes identifying and resolving issues with payroll systems, aligning all past and future payments with employment agreements and the Act; and calculating all past and present employee entitlements for a period up to 6 years (requiring 7 years of data).
In some circumstances this could mean over 300 calculations for an individual employee with cumulative and flow on effects.
